Digital Phone Subscription Agreement

Thank you for choosing Blue Ridge for your telecommunications services. By completing this form below you authorize Blue Ridge to provide you with its local and/or long distance service. Your signature certifies that you have read and understand this letter of authorization, are at least 18 years of age, and have the authority to make changes to the telephone numbers listed below.

Please read the following carefully, initial under each paragraph (on the line provided), sign your name and provide your date of birth at the bottom of the page. 

I choose Blue Ridge Communications to provide local telephone service for the telephone number and billing address entered with this order. I authorize Blue Ridge Communications to serve as the authorized agent to effectuate the change of my local telephone service.

I understand that Digital Phone does not support, install or re-install Alarm Systems, Life-Alert, Dial-Up or Ring Mate. If my phone is being utilized for an alarm system and Digital Phone is being installed, I understand that I may need to contact my alarm company for a reconfiguration of my alarm system.

I am aware that Digital Phone does not include back-up power and, as is the case with an electric-powered home cordless phone, should there be a power outage, Digital Phone will not be available.

I understand that additional charges apply for taxes, fees, directory/operator assistance and international calls.

I understand that Digital Phone allows access to E911 service that may not be accessible in the event of a power or network outage, or if my broadband connection is unavailable.

I understand that I should not move my Digital Phone equipment without notifying Blue Ridge Communications at 1-800-222-5377. The address associated with E911 is the original service address on record. If your Digital Phone equipment is moved to another address, calls to E911 using that equipment will still identify the original service address.

DIGITAL PHONE BATTERY BACKUP:  Your Blue Ridge Digital Phone service utilizes telephone equipment that is connected to your home’s power.  During a power outage, you will not have access to phone service or e911 unless a battery is installed and attached to the telephone equipment at your home.  Backup batteries are available for purchase. Blue Ridge offers eight hour and 24 hour backup batteries. Eight hour batteries can provide up to eight hours of standby service or up to four hours of talk time using a telephone that itself does not require power and is directly connected to the telephone equipment’s jack. Twenty-four hour batteries provide up to 24 hours of standby service or up to eight hours of talk time.  Backup batteries are available to purchase from Blue Ridge either when you order Blue Ridge Digital Phone service or after installation. Batteries must be professionally installed, and installation fees may apply. Blue Ridge cannot guarantee that batteries purchased from sources other than Blue Ridge will be compatible Blue Ridge’s telephone equipment.

Battery Information:  Under normal operating conditions, most batteries will not need to be replaced for several years. However, factors such as age and temperature could impact battery performance.   Batteries should be stored between -4 and 140 °F.   Please be aware that storage above 77°F reduces battery life.  After installation, we recommend that you check the battery status on a regular basis, ideally twice a year.   Customers are responsible for monitoring their backup power.   Audio and visual indicators emitted from the battery will inform you if the battery is low or needs to be replacedPlease be aware that this backup power will not power services other than voice, including home security service.

I understand it is my responsibility to inform all household residents, guests, and other third persons who may be present at the physical location where Digital Phone service is utilized as to the important limitations on emergency response services as detailed herein.

I understand and acknowledge that Blue Ridge, its affiliates, subsidiaries, parent companies and network service providers, will have no liability whatsoever with respect to 911 dialing on Blue Ridge’s Digital Phone service.

I agree to defend, indemnify, and hold harmless the aforementioned entities from any claims, losses, damages, costs and expenses (including reasonable attorney’s fees) relating to such 911 dialing by myself and/or any user of my Digital Phone service.

WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY: Blue Ridge, its affiliates, and parent company disclaim all warranties or remedies for breach of warranty, whether statutory, express or implied warranties, including, without limitation, any warranty of merchantability, non-infringement, or fitness for a particular purpose.  In no event shall Blue Ridge or any of its affiliates be liable in contract, tort or otherwise for any loss, claim or damages of any other kind, whether direct, incidental, consequential, exemplary, special, punitive, remote or otherwise, including any lost profits, lost revenue, loss of equipment, cost of purchased power, cost of substitute product, facilities or services, claims of customers of owner, or removal, shipping, transportation or installation expenses. 

BLUE RIDGE MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE GOODS, INCLUDING ANY 

(A) WARRANTY OF MERCHANTABILITY; OR (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE;

WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE.

By entering my name in the box below, I acknowledge that I have read and understand the Subscription Agreement and authorize Blue Ridge Communications to become my new preferred service provider for each of the services I have chosen. I understand that only one service provider may be designated for the telephone number and billing address listed on your account. I am at least 18 years of age and legally authorized to change telephone companies for service to the telephone number listed above.
